Some of you might know that I am in the middle of trying to win a tort claim I have filed against the state of Indiana for wrongful termination. See my previous blogs in this section for more information. I need to keep this story in the news and fresh in people's minds as the Attorney General's office is in the middle of their decision to settle this without having to go to court. Karen - 1. BMV - 0

Well, I have won the first battle in my continuing fight against the BMV and the state of Indiana. I had applied for unemployment on October 2nd. As expected, the BMV tried to say I was fired for poor job performance. Well, lo and behold I got my determination from the Department of Workforce Development today and they approved my claim. They said that the BMV could not show just cause for my termination and I would be receiving my checks effective immediately. So now the first battle has been won. This should definitely make it easier for me to win my case against the state. I'm ready to fight!
Yesterday was interesting. First of all, due to the resignation of Joel Silverman, Indiana BMV Commissioner, I was contacted again (via e-mail) by Pam Elliot at Channel 8 news to come in and do another interview. I definitely want to do another interview. I feel that my wrongful termination by the BMV has basically ruined my life. The personal and financial problems that have happened as a result of my firing are devastating. Losing my job there has cost me and my two children a lot of pain and suffering in a HUGE way. I shared with Pam that it seems the timing of Mr. Silverman's resignation is interesting. My attorney filed suit against them on September 12. The fact that this is an election year really poses a huge problem for the Republicans in that they may end up losing control over state government to the Democrats. The fact that all of this pain and heartache I'm experiencing is due to fallout from decisions from the Republican Governor's staff could be a big problem for them.... especially if I talk to Channel 8 again. I think this situation is at least partly to blame for the timely resignation of Silverman. Good riddance there. My attorney has advised that I not go public just yet. He has been contacted by someone high in state government that is reviewing my case and he doesn't want to "show our hand", so to speak, by speaking to the press just yet. I am eager to share my problems with the entire state of Indiana, via the press, but timing is everything. And that's the latest :o) More to come, I'm sure.

Karen vs Indiana BMV

I was an employee for the Indiana Bureau of Motor Vehicles. I was a very good worker, always eager to help others and generally a very good employee. We got a new computer system in July. It sucked azz, I mean really. I sent a letter to the Governor of Indiana about my dissatisfaction with the new STARS computer program. Being an employee of the BMV, I felt I was offering an insiders view of the bad data and frustration about not being able do my job since June 30th. Driving records are wrong, suspensions are showing up on peoples records that shouldn't be there. Car registration information is all screwed up. It was a mess! I sent this letter to our Governor... utilizing his "open door policy" with Indiana citizens and state employees... on July 17th, 2006. I was FIRED July 18th. What did I do? I contacted Channel 8 news. What did they do? Well they contacted me for an interview. I didn't realize that I lived in a Communist state. I didn't feel that alerting the Governor the problem was in error, but apparently I uncovered the cover-up of the century!!
